§1. Seller's identification data

The seller sells using the dropshipping model, which means that the products offered in the store are shipped directly from suppliers located outside the European Union (mainly from China).
§2. Definitions

Store – online service available at www.marbellafashion.pl, through which the Customer can place orders.

Seller – Perfect Choice Kamil Gajowy.

Customer / Consumer – a natural person making a purchase in the store for purposes unrelated to business activity.

Product – a movable item available in the store’s offer, sent to the Customer by an external supplier.
-
Order – a declaration of will by the Customer aimed at concluding a sales contract for a specific product with the Seller.
§3. General provisions

These Regulations define the rules for using the online store, placing orders, concluding sales contracts and the rights and obligations of the parties.

Using the store constitutes acceptance of these Regulations.

All prices are given in Polish zloty (PLN) and include VAT (where applicable).

The store does not conduct wholesale sales.
§4. Nature of business – dropshipping

The Marbella Fashion store operates on a dropshipping model, which means that products ordered by the customer are shipped directly from external suppliers, mainly from China.

The seller is not the physical owner of the goods at the time of purchase.

Due to the international nature of shipments, products may be subject to customs control, excise duty or additional import fees , which are borne by the Customer.

The Seller is not responsible for any delays resulting from customs or excise procedures or decisions of border services.

The store is not responsible for differences in quality, fabric texture, color shade or slight dimensional differences resulting from the production process or transport conditions.
§5. Orders

Orders can be placed via the website 24 hours a day, 7 days a week.

The condition for order fulfillment is the correct completion of the form and payment.

The customer will receive order confirmation to the e-mail address provided in the form.

The sales contract is concluded upon confirmation of the order by the Seller.
§6. Delivery

The order processing time depends on the supplier's country of origin and is described in detail in the Delivery Policy available on the store's website.

When purchasing goods originating from outside the European Union (especially from China), delivery times may range from 10 to 30 business days.

The Seller shall not be liable for delays resulting from reasons beyond its control, including, but not limited to, customs clearance, public holidays, carrier actions or force majeure.
§7. Payments

Available payment methods include fast online transfers and card payments via secure payment operators.

The Store does not store the Customer's payment card details.

Orders not paid within 48 hours may be cancelled.
§8. Returns and complaints

The consumer has the right to withdraw from the contract within 14 days of receipt of the goods, without giving any reason.

Returns are made at the customer's expense , unless the product is damaged or does not comply with the order.

To exercise the right of return, the Customer should contact the store staff by e-mail at: kontakt@marbellafashion.pl.

Complaints should be submitted in writing or by email, with a description of the defect and photographic documentation.

The Seller will consider the complaint within 14 days of its receipt.
§9. Personal data and cookies

Customers' personal data are processed in accordance with applicable law, including the GDPR.

The principles of personal data processing and the use of cookies are described in the Privacy Policy and Cookie Policy , available on the store's website.
§10. Liability

The store is not responsible for:
delays resulting from the actions of courier companies or customs offices,
differences in the appearance of products resulting from the Customer's screen settings,
customs duties and import taxes imposed by customs services,
damage or defects resulting from international transport, if they are not the fault of the Seller.
§11. Final provisions

The Regulations come into force on the date of their publication on the store's website.

The Seller reserves the right to make changes to the Regulations.

In matters not regulated by these Regulations, the provisions of Polish law shall apply, in particular:
Act of 30 May 2014 on consumer rights,
Act of 23 April 1964 – Civil Code.

Any disputes between the Customer and the Seller will be resolved by the court having jurisdiction over the Seller's registered office.
